What are personal data?

According to current legislation, personal data is considered to be any information that directly or indirectly identifies a natural person. Information that has been pseudonymised, dissociated or aggregated and therefore does not allow a natural person to be identified is not considered personal data.

Besides, MercaTuber guarantees you that it has adopted the appropriate security measures in its facilities, systems and files. In compliance with the provisions of the European Regulation 2016/679 General Data Protection Regulation, as well as any national law that may be applicable, we inform you that at MercaTuber we process personal data that you provide for the following purposes:

1. To process your registration as a customer, to manage the purchase process and to manage your contractual relationship with us.

2. To process your registration as a seller, manage the sales process and manage your contractual relationship with us.

3. Manage our services, including reminders, technical notices, updates, security alerts, support messages, among others.

4. Sending commercial communications about MercaTuber’s products, as well as promotional and advertising activities of our own or third parties by any means (e-mails, telephone, SMS, push notifications, post, etc.), which may be of interest to you, based on the study and segmentation of the data collected while browsing the web, the data provided by filling in any form, as well as those derived from the commercial relationship or delivery of the products purchased. Furthermore, in the event that you do not wish to receive any more advertising, all you have to do is enter your account and deactivate the sending of communications.

5. Preparation of commercial profiles based on information obtained from internal and external sources, in order to send you personalised advertising and analyse your purchasing behaviour.

6. To carry out statistical studies that allow us to improve our services and to carry out basic administrative tasks.

Your data will be retained for the duration of the contractual relationship, or you request deletion or portability, as well as for as long as necessary to comply with legal obligations. Current legislation requires financial records to be kept for a certain period of time.

If you withdraw your consent or object to the processing, the data will be blocked and will no longer be processed, and will be kept for a period of 4 years for the purpose of making claims or defending ourselves against possible claims.

The legal bases for the processing of your personal data corresponding to each of the purposes (1) to (5) included in the “Purposes” section are as follows:

– Purpose (1): The execution of a contract with MercaTuber in relation to the purchase of products.

– Purpose (2): Express consent given to MercaTuber when collecting your personal data.

– Purposes (3) and (4): Express consent given to MercaTuber at the time of collection of your personal data in relation to profiling based on external sources and the satisfaction of a legitimate interest of MercaTuber in relation to profiling based on internal sources.

– Purposes (5): Compliance with the legal obligations applicable to MercaTuber.

Your personal data will not be passed on to any third party, except to those third parties for whom their intervention is necessary for the correct management of the provision of the service (sellers, carriers, financial institutions, etc.).

MercaTuber will stop processing your data, except for compelling legitimate reasons, or the exercise or defence of possible claims.

Likewise, you may exercise your right to data portability, as well as withdraw the consents provided at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

The request to exercise any of your rights must be accompanied by a copy of an official document that identifies you, ID card, NIE or Passport.

Likewise, we inform you that you may contact the Spanish Data Protection Agency and other competent public bodies for any claim arising from the processing of your personal data.
